Holidays in Kefalonia .... Terms and Conditions
Please read these Terms and Conditions before proceeding to complete our Booking Form. These Terms and Conditions govern all bookings with Holidaysinkefalonia.com ("the Company"). Any booking made or order placed by you, whether through the Company's website or otherwise, shall be deemed an offer by you to rent the
relevant accommodation subject to these Terms and Conditions. All bookings through
our Company and all matters arising from them are subject to English law and to the exclusive jurisdiction of the courts of England and Wales. The person who makes the booking accepts these conditions on behalf of all members of the party and is responsible for all payment due from the party. Booking services with the Company are currently only available to persons who are at least 18 years of age. By submitting a booking you warrant and confirm to us that you have read these Terms and Conditions and agree to
comply with them.
In consideration of the fact that the Company acts only as a booking agent, the Company accepts no liability whatsoever for any aspect of the arrangements and, in particular, accepts no liability for any loss, personal injury/illness or death however incurred. Although the Company uses all reasonable endeavours to ensure the accuracy of all information provided and the quality and facilities of the apartment/villa, we cannot accept any liability whatsoever for any problems that occur while guests occupy the apartment/villa
of their choice. All information has been provided in good faith and no liability is accepted whatsoever by the Company for any misrepresentation of apartment/villa material or accommodation.
The Company shall not be liable for any temporary defect, interruption or stoppage in the supply of services to the accommodation (i.e. electricity, water), nor in respect of any equipment, plant machinery or appliance in the property, garden or swimming pool.
In the event of any problems whatsoever the total liability of Holidaysinkefalonia.com will be limited to the rental amount paid by the client.
Number of persons
The villa/apartment accommodation is reserved exclusively for the people named on the Booking Form and no other persons whatsoever are permitted to stay in the property unless this has been agreed with us in writing prior to your holiday.
If you have any special request you must advise us at the time of booking in writing. Whilst we will endeavour to meet any reasonable requests we regret we cannot guarantee any request will be met. Failure to meet any special request will not be a breach of the booking on our part.
If you or any member of your party has any medical problem or disability that may affect your stay, please tell us before you confirm your booking so that we can advise as to the suitability of the chosen accommodation. In any event, you must give us full details in writing at the time of booking. If we reasonably feel unable to properly accommodate the particular needs of the person concerned, we must reserve the right to decline their reservation or, if full details are not given at the time of booking, cancel
when we become aware of these details.
Passports, visas and health requirements
It is your responsibility to ensure that you are in possession of all necessary travel and health documents (including Passports and Visas [where applicable] before departure. Please check with the relevant Consulate or Embassy for up-to-date information in plenty of time prior to your holiday. The Company are unable
to accept any liability if you fail to carry the correct passport, visa or any other documentation that may be required and which may impede your entry onto a flight or entry into Kefalonia.
A deposit payment for all apartments/villas and accommodation is required at the time of booking. In the event that the Company is unable to obtain final confirmation of availability for the selected accommodation a full refund of the amount paid will be made. The Company will not accept responsibility for cash sent through the post. Payment for the deposit is to be made on-line, using Paypal's secure servers, with a credit/debit card. Booking confirmation for the apartment/villa will be sent by email. Guests
be advised at the time of booking the method by which the balance must be paid. In most cases the balance must be paid in cash, in Euros, directly to the apartment/villa owner on the day of arrival at the chosen accommodation. However, for certain villas/apartments the balance must be paid by cheque within 8 weeks of the commencement date of the booking and must be sent to the address of the owner of the villa/apartment. The Company will provide the client with the address of where to send the cheque within two
weeks of the due date of the balance payment. In this case, if the balance is not paid within 7 days of it being due, then we reserve the right to cancel the apartment/villa booking without any refund.
Cancellation by you
You or any member of your party may cancel your booking at any time however no refund will be made for any monies paid. In certain cases any loss, if incurred involuntarily, may be covered by insurance that you may have taken out. It is strongly recommended that you take out adequate Travel Insurance. Please read your policy details carefully.
It is your responsibility to ensure that the insurance cover you purchase is adequate for your particular needs.
Cancellation by the Company
If deemed necessary the Company reserves the right to withdraw or cancel the apartment/villa booking. In this unlikely event you will be offered the choice of renting another apartment/villa through the Company (subject to availability) with the price difference payable/refundable as appropriate, or of receiving a full refund of all monies already paid. No compensation is payable by the Company.
Damage and Breakages
Should you or any member of your party be responsible for any breakages, loss or damage of any item from the property or additional cleaning has been necessary, a charge will be made locally prior to your departure.
Safety and Behaviour
At all times during your holiday you are expected to have consideration for your fellow neighbours and other third parties. If, in the opinion of ourselves, the owner/agent of the property, or other person in authority you are, or appear to be, behaving in such a way to cause danger, distress or damage to the property, we reserve the right and may terminate your holiday arrangements.
In this event we will have no further liability to you and will not be responsible for any expenses you incur, any refund or any compensation. In addition you will be responsible for any additional expenses we may incur as a result of your behaviour.
The villas/apartments with swimming pools do not have a lifeguard on duty. You and your party must observe and enforce the pool safety notice displayed in the pool area. Neither the owners, nor the Company accept liability for any injury howsoever caused as a result of using any swimming pool. All children must be closely supervised at all times, in particular around the pool areas, balconies, hillside roadways and walls.
Noise and Building Work
Wherever you choose to stay there will often be some surrounding noise e.g. motor vehicles, residents of other properties or country sounds from animals and birds. Properties within the village can expect noise associated with the location. Noise levels will naturally increase during peak season.
Much of the island of Kefalonia is still
being developed, roads improved and new accommodation constructed. Holidaysinkefalonia.com cannot be held responsible for any building work noise external to the property that you have rented and you acknowledge this as part of the Terms and Conditions of your booking with us. This includes renovation works on adjoining or adjacent properties (encompassing house extensions, garden renovations/remodeling, new installations i.e. swimming pool construction, etc), and local authority works on roads and local amenities.
We have no control over these works nor are we given prior notice. We will always do our best to keep you informed but if this is not possible please accept our apologies. Whilst we assure you of our best endeavours to minimise any inconvenience we regret that we cannot accept any liability in this case.
Holidaysinkefalonia.com cannot be held responsible for unusual and unforeseeable circumstances beyond their control, the consequences of which are unavoidable, including but not limited to war, riot, civil strife, terrorist activity, industrial dispute, natural or nuclear disaster, fire, flood, adverse weather conditions or the threat of any of these.
Whether the cost of any air-conditioning is included in the apartment/villa price, or paid for as a supplement locally, the units must only be used while you are in the property, with all windows and doors kept closed. Under no circumstances must the units be left on continuously while the property is unoccupied. Where the air-conditioning is payable as a supplement locally, should you elect to use this facility, it must be paid for at the advertised rate.
Alterations by the Company
Although the Company makes every effort to ensure that advertised descriptions are correct, it does not own any of the apartments/villas and therefore cannot control or prevent changes. Although changes to apartments/villas advertised are infrequent, the Company reserves the right to change the description of any apartment/villa or service at any time, in which case we will endeavour to notify you of all changes before commencement of the booking date, if it is practical to do so. No compensation will be payable
by the Company in such cases. No claims will be accepted for costs or additional expenses incurred as a result of any changes.
This Agreement is for the purposes of a holiday rental only and does not create the relationship of Landlord and Tenant between you and Holidaysinkefalonia.com. You will not be entitled to a tenancy or to any other form of statutory security of tenure as a result of this Agreement.
All personal data provided to Holidaysinkefalonia or our associate web sites (Astro-holidays.com) will be held and processed in accordance with the requirements of the 1998 Data Protection Act. We will keep your personal data safe and secure. We will not share it with other organisations without your knowledge and consent, unless required by law to do so.
